Failure to Appear or Failure to Pay Violations

This section provides you information when you fail to appear in court (FTA), fail to pay your fine (FTP) and how to clear a hold on your driver’s license and dealing with your case in collections.

If you have received a Failure to Appear Notice

To avoid collection activity, you must do one of the following within 25 days from the post-marked date on the mailing envelope.

You may pay the bail listed above or appear in court on or before the due date. If you wish to appear in court you must receive a yellow card from the clerk on the day you wish to appear. You have other options for resolving your case without appearing in court, unless your appearance is mandatory

If you have a financial hardship and can show that you are unable to pay the full amount for the offense(s) on your traffic ticket, you may request the Court to consider your ability to pay in setting the fine amount. However, you must appear before the Court to do so. You should come to court with the completed “Petition For Consideration re Ability to Pay” form (TR-105RC). This form can be obtained at the Courts counter or website. Also, if you are ordered to pay a fine you may ask the Court for an installment payment plan that is based on your ability to pay, or ask the Court to approve community service due to financial hardship.

  • On-Line Payments: You may pay by credit card on our website at www.fresno.courts.ca.gov
  • Mail Payments: The Court accepts personal checks, cashier’s checks, or money orders made payable to the “Fresno Superior Court” and mailed to the Traffic Division, 1100 Van Ness Avenue, Fresno, CA 93724-0002, or
  • In-Person Payments: can be made at the “M” Street Courthouse located at 2317 Tuolumne Street, Fresno, CA 93724. Office hours are 8:00 a.m. – 4:00 p.m., Monday through Friday, except holidays.

Note: Requests to set up installment payments or to attend Traffic School are currently unavailable on-line. You may set up the payment plan or Traffic School by mail or In-person.

If you fail to appear or pay this citation within 25 days, it will be deemed that you willfully failed to appear. A civil assessment fee of $300.00 pursuant to PC 1214.1 and additional court fees will be assessed, and your case will be referred to a collection agency. Your failure to appear or pay may also be deemed as your consent to have the case proceed as an infraction, your election to a trial by declaration pursuant to VC Section 40903 and Fresno Superior Court Local Rule 3.6.2, and your waiver of the following rights: to be present at your jury or court trial, to be represented by an attorney, to testify and/or present evidence on your behalf, to confront and cross-examine the witnesses against you, and to use the subpoena power of the Court to compel the attendance of witnesses on your behalf.

If you have received a Failure to Pay Notice

You may appear before a judge on your case.

For Traffic Infractions-you may appear at the M Street Courthouse. You must receive a yellow card from the clerk on the day you wish to appear.

For Criminal Cases-you must appear the Fresno Central Division to schedule a future court date.

If you have a financial hardship and are unable to pay the full amount due you may ask the Court for installment payments or an alternative to paying the fine. You should appear before the Court with a completed “Petition For Consideration re Ability to Pay” form (TR-105RC). This form can be obtained at the Court’s Counter or website. You may be asked to provide financial documentation in support of your request.

If you fail to pay this court ordered fine within 25 days, it will deemed that you willfully failed to pay and your license may be suspended, a civil assessment fee of $300.00 pursuant to PC 1214.1 and additional court fees will be assessed, and your case will be referred to a collection agency.

My Case is at Collections what can I do?

You may make payment arrangements with the collection agency or file an “Application and Order to Vacate Civil Assessment” with the delinquent amount to request that the civil assessment fee be vacated. If you are unable to post the delinquent amount you may file a “Petition to Waive Deposit of Bail for FTA Traffic Court Trial FTA or Civil Assessment Application.” Both forms are available on the Court’s website at www.fresno.courts.ca.gov under “Forms”. The completed application and/or petition will be submitted to a Judge for review.

What is a Civil Assessment?

Pursuant to Penal Code §1214.1, an additional $300 Civil Assessment fee may be added to your cases when you fail to appear and/or when you fail to pay your court ordered fine.

You may request that the Court vacate the Civil Assessment fee by filing an Application and Order to Vacate Civil Assessment upon a showing of good cause (i.e. hospitalization, incarceration, out of state military duty). Written documentation must be submitted with the Application along with posting the delinquent amount.

If you are unable to post the delinquent amount you may file a “Petition to Waive Deposit of Bail for FTA Traffic Court Trial or Civil Assessment Application"

How can I get the hold on my Driver's License lifted?

If your driver’s license or registration has been placed on hold by the Court with the Department of Motor Vehicles you may be able to pay the full bail amount to clear or release the hold. The Court will customarily notify the Department of Vehicles within 10 days of your compliance to release the hold.
