The Probate Examiners review all probate documents for content and legal requirements before they are acted upon by the Court. Probate Examiner Notes are summaries prepared by the Probate Examiners after reviewing your documents. The summary is referenced by the Probate Judge during the review process. Probate Examiner Notes may include an identification of the parties involved in the matter, the relief sought, summaries of filed documents, and a listing of potential deficiencies.
Any potential deficiencies will be listed on the Probate Examiner Notes in the right-hand "Needs/Problems/Comments" column and should be addressed and/or corrected before the matter is heard by the Court. Responding to the deficiency includes filing a clarifying or an explanatory declaration, or an amendment or supplement to your petition. All documents correcting and/or addressing issues raised in the Probate Examiner Notes must be in a format that is fileable with the court; e-mails and faxes to the Probate Examiners are not sufficient. Pursuant to Local Rules 7.3(E) and 7.4.1, all documents curing or addressing the deficiencies must be filed at the Probate Clerk’s office at least twenty-four (24) hours in advance of the hearing date in order to be considered by the Court.

It is the goal of the Probate Department to have Probate Examiner Notes posted four (4) court days prior to the hearing. Probate Examiner Notes are updated and posted twice daily at 11:00 a.m. and again at 4:00 p.m. and are only available for viewing on this website through the day of the hearing.
